Arizona DPS Arrests Man For 2nd Degree Murder

Arrest stems from man’s role in fatal collision

PHOENIX - On Nov. 7, 2013, Benjamin Charles Kuzelka, 27, of Phoenix, was taken into custody by DPS detectives for his involvement in the Oct. 6, 2013, wrong-way collision that claimed the life of Mary A. Boysman, 55, of Oswego, N.Y. Raja Maramuthu, Boysman’s driver, was seriously injured in that collision.

Detectives from the Arizona Department of Public Safety (DPS) Vehicular Crimes Unit (VCU) took Kuzelka into custody after he was released from John C. Lincoln North Mountain Hospital, where he had been recovering from injuries sustained during the collision.

On Sunday Oct. 6 at around 4:30 a.m., Kuzelka drove the wrong way, northbound within the southbound car pool (HOV) lane of State Route 51 between Bell and Greenway Road. He collided head-on with Maramuthu’s Sport Utility Vehicle. The two vehicles spun clockwise 90 degrees before coming to rest just a few feet from the area of impact.

Boysman, a passenger in the SUV, was not wearing a seat belt.

Boysman was transported from the scene, but was pronounced deceased a short time later. Maramuthu was also transported from the scene with serious injuries. Maramuthu was released from the hospital on Oct. 10, however he has not been able to return to work due to his injuries.

VCU detectives are also recommending that Kuzelka be charged for aggravated assault, five counts of endangerment, aggravated DUI and criminal damage.
